Märklin Privacy Terms

1. The Controller and general  principles

We, Gebr. Märklin & Cie. GmbH, Stuttgarter Straße 55-57, 73033 Göppingen, Germany as operator of “http://www.maerklinshop.de “ (hereinafter “Online-Shop” or “Website") are

Controller for the Online-Shop user’s (hereinafter “you”) personal data in the meaning of the German Data Protection Act (Bundesdatenschutzgesetz („BDSG“).

Your confidence and the protection of your privacy is of special concern to us. Therefore, we take the protection and the safety of your personal data very seriously. Your personal

data will only be collected, processed and used observing the data protection regulations, in particular the provisions of BDSG and German Tele Media Act (TMG).

Hereinafter we will inform you according to our information obligations, which data will be collected when visiting our Online-Shop and using our services and offers and how these

will be processed and used by us thereafter. Furthermore, we will inform you which accompanying protective measures we have undertaken in technical and organisational means.

2. Collection and use of your personal data

Personal data is any information concerning personal or material circumstances of an identified or identifiable individual. Consequently, your personal data is all information

which may be assigned to your person, e.g. your name, address, telephone number or your e-mail address.

Your personal data is collected and used to facilitate the use of our Website and our services and offers. Personal data is only collected, processed or used by us, if and as far

as you have provided us with the relevant data for a concrete data collection or use voluntarily, a legal provision allows the concrete data collection and/or use or you have

expressly agreed to the concrete data collection and/or use in advance.

Scope and kind of the data collection and use of your data differ, whether you visit our Website only to retrieve information or to make use of our offered services.

a) Informational use of our Website

If you visit our Website for informational purposes only, it is not required to provide us with personal data.

We collect and use only those of your data, your internet browser transfers automatically, as for example, the addressed paged, type and operating system and the internet browser

used by you, the IP-Address of the computer, date and time of the visit of our Website, access status, transferred data volume, websites visited.

This data is collected and used by us in an anonymized way during a visit of our Website for only informational purposes in order to enable the visit of our Website, for

statistical purposes and for the optimization of our internet offer. Your IP-Address will be shortened by the last octet (segment). A combination of this data with personal data of

a special natural person will not happen. Your IP-Address will be saved only temporarily for the time of your visit.

b) Use of services

If you would like to make use of the services offered in our Online-Shop, e.g. order goods, it is necessary that you provide us with your personal data. We collect and use your

personal data for the following purposes:

Account: When establishing your personal account we will ask you for various data (e.g. name, address, delivery address, e-mail address) as well as data you inform us voluntarily

(e.g. your telephone number) via the provided form. Your data will be used to administer your account and to provide the associated functions, as e.g. the editing of your costumer

data, your merchants, your club membership and the display of you orders.

Orders: We collect, process and use exclusively the personal data which are necessary to fulfil, process and, if applicable, to rescind your order. Within the ordering process we

therefore collect, process and us the required data (e.g. name, address and e-mail address, telephone number, date of birth, payment information, e.g. banking account as well as

delivery specifications, e.g. delivery address and further information).

Contact/Feedback: If you contact us, e.g. to give us feedback, the collection, processing and use of your data provided by you voluntarily (e.g. name, e-mail address, phone number)

is effected to answer your questions/proposals you made via the feedback form, e-mail or in a different way.

Newsletter:  If you register for our newsletter, we need besides your declaration of consent at least your e-mail address we shall send the newsletter to.

Further information, if any, is voluntarily and will be used to address you personally and to individually arrange the content of the newsletter as well as to clarify questions

regarding the e-mail address. We will only send a newsletter to you after you have verified your registration by clicking a link in an e-mail sent to you for this purpose only. We

want to make sure that only the owner of an e-mail address is able to register for our newsletter. Your verification has to be made promptly after receiving the confirmation e-

mail, otherwise the newsletter registration will be deleted automatically from our data base. You may unsubscribe from our newsletter by entering your e-mail address on

maerklinshop.de/en/newsletter and selecting “unsubscribe to newsletter” in the drop down menu or by clicking “to unsubscribe here” at the end of any newsletter. The personal data

collected for the aforementioned purposes will be used only within the specific purposes or it is required for our own legitimate business interests. A transfer of your personal

data to third persons if and as far as this is required is only effected for the aforementioned purposes, e.g. to a bank to process the payments. Besides your personal data will

not be passed on to any third party without your prior consent, if not a judicial or official order obliges us to do so.

3. Credit Check

You may pay your order via direct debiting scheme. As we will deliver the ordered goods to you before the invoiced amount is charged and as an eight-week revocation right exists at

direct debiting scheme, we obtain information regarding your creditworthiness covering your payment history and payment risk based on mathematic-statistic methods using address

data (Scoring) from infoscore Consumer Data GmbH, Rheinstraße 99, 76532 Baden-Baden, Germany, to secure our legitimate interests. For this we communicate the necessary personal

data (name, date of birth, your address and bank data) to infoscore Consumer Data GmbH, in which your address data is considered. Based on this information a statistical

probability for non-payment will be calculated. We use this information for our decision to conclude, perform or terminate a contract.

4. Cookies and Targeting

Cookies are small text files which will be sent to your browser by our web server during your visit of our Website and will be saved on your computer for a later access of our

Website. We use so called “session cookies” which will be deleted, when you close your browser and so called “persistent cookies” which will be saved on your medium for a longer

time but two years at most. You do not have to accept cookies when visiting our Website. However, the usability is limited if you do not accept cookies.

a) Cookies

If you visit our Website we retrieve the following information about your computer: IP-Address, browser request and time of request. Furthermore, the status of the transferred data

volume during this request is recorded. We collect product and version information about the browser used and the operating system of your computer. We record form which website

the access to our Website is effected. The IP-address of your computer is only saved for the time you use the Website and will be deleted immediately thereafter or anonymised by

shortening. The further data will be saved for a limited period of time. We use this data to operate our Website, in particular to find out and fix bugs, to determine the operating

grade and to undertake adjustments and improvements.

We may also collect information regarding the use of our Website by using so called “browser cookies”. These are small text files collected on your computer, which will save

certain settings and data to communicate with our system via your browser. A cookie generally contains the domain name the cookie is sent from as well as information about the

cookies’ age and an alpha numeric identifier. Cookies enable our systems to recognize the user’s device and to make available pre-settings, if any. As soon as a user accesses our

Website, a cookie will be transferred to the user’s computer hard disc. Cookies help us, to optimize our Website and to offer you a better service specific to you. They enable us

to recognize your computer, when returning to our Website and:

The cookies used by us will only save the aforementioned data regarding the use of our Website. We will not assign this data to you personally, but by allocating an identification

number to the cookie (“Cookie-ID”). We will not consolidate the Cookie-ID with your name, your IP-address or any similar data which could allow a correlation to you.

b) Targeting

Our Website uses so called tracking technologies. We use these technologies to offer you a more interesting Website. This technology enables us to address internet users who

already showed interest in our Website on websites of our partners with adverts. The adverts on websites of our partners are based on a cookie technology and an analysis of the

previous customer behaviour. This analysis is effected pseudonymously and no user profiles will be merged with your personal data. If you do not consent with the compilation of

user profiles, you may object by writing us a message. We will then place a special opt-out cookie on your computer, which has to be saved permanently. If you should delete this

cookie or it is deleted by browser settings automatically, you fill have to set this cookie again if you visit our Website at a later time.
 
We cooperate with business partners which assist us to arrange the internet offer and the Website more interesting for you. Therefore, also cookies of these business partners will

be saved on your computer when visiting our Website (“third party cookies”). These cookies will be deleted automatically after the specified time. Our business partners’ cookies

also only collect data by using a Cookie-ID which allows our partners to address you with advertisements really of interest for you.

c) Preventing the storage of cookies

If you should not wish that browser cookies are used, you may configure your browser in a way that cookies cannot be saved. Please note that in such case you may use our Website

only in a limited way or not at all. If you only wish to accept our own cookies, but not the cookies of our service partners and business partners, you may choose “block third

Our website uses Google Analytics, a web analytics service provided by Google, Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer,

enabling to analyse how you use the website. The information generated by the cookie about your use of the website (including your IP address) will generally be transmitted to and

stored by Google on servers in the United States. In case of activation of the IP anonymization, Google will truncate/anonymise the last octet of the IP address for Member States

of the European Union as well as for other parties to the Agreement on the European Economic Area. Only in exceptional cases, the full IP address is sent to and shortened by Google

servers in the USA. If demanded by us, Google will use this information for the purpose of evaluating your use of the website, compiling reports on website activity for website

operators and providing other services relating to website activity and internet usage to the website provider.

Google will not associate your IP address with any other data held by Google.
You may refuse the use of cookies by selecting the appropriate settings on your browser. However,

please note that if you do this, you may not be able to use the full functionality of this website.

We point out that Google Analytics is used with the add on „_anonymizeIp()“ and only your shortened IP address will only be processed to avoid a direct personal assignment.

6. Third Party Content

On our Website content of third parties may be embedded, e.g. Google Maps and Videos from YouTube. It is required that the provider of such content perceives the user’s IP-address

to be able to send the content to the user’s browser. We seek to use only content of which the provider uses the IP-address for the delivery of the content only. We have no

influence though whether the particular provider saves the IP-address e.g. for statistical purposes.

7. Data protection

We take technical and organisational precautions to secure incoming or collected personal data, in particular against accidental or deliberate manipulation, loss, deletion or

against offences of unauthorized persons. Our precautions will be improved continuously according to the technological development.

Our Website is SSL encrypted as far as you actively enter personal data or payment data in order to prohibit access from unauthorized third persons.

8. Your rights

We point out that you are entitled to revoke your data protection consent, if any, at any time effective for the future.

Furthermore, you are entitled, to demand disclosure at any time at no charge about saved personal data concerning you, if the legal requirements are at hand. Under the statutory

preconditions, you are entitled to demand correction, erasure and blocking of this data.
